Privacy Notice of ZAGIS, S.A. DE C.V.
This Privacy Notice is established in compliance with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties (the “Personal Data Law”) and is published on its WEB page: www.zagis.com.
All terms used with an initial capital letter not defined herein shall have the meaning attributed to them in the Personal Data Law.
- Identity and address of the Controller. The Controller of the Processing of Personal Data is ZAGIS, S.A. DE C.V., with address at: Carretera Federal México Querétaro km. 69, piso 1, Col. San Mateo Segunda Sección, Tepeji del Rio de Ocampo Hidalgo, CP 42884.
- Purposes of the Processing of Personal Data. There are various purposes for the Processing of Personal Data carried out by ZAGIS. The main reasons why ZAGIS collects Personal Data are the following: A. With respect to its service providers, to maintain adequate internal control, as well as to make the corresponding payments derived from the provision of services, to make withholdings and tax payments, as well as to determine the persons who should be contacted in the event of an emergency occurring with respect to each service provider. B. With respect to its clients or officials of its clients, for the sale of its products, economic or any other area related to the services it provides and to collect payments generated by the sale of its products. C. With respect to its suppliers, to make requests for products and services, as well as to make payments for the products they provide or for the services they provide.
In general, the Personal Data that ZAGIS collects from the Holders are names, addresses, telephone numbers, email addresses and, in some cases, resumes, bank account numbers, articles of incorporation, financial and tax information.
In the event that, at the time of collecting Personal Data, there is a purpose for the Processing of the same other than those indicated in this section II, ZAGIS will notify the Owner, so that, if necessary, he/she may express his/her Consent to the corresponding purpose.
Likewise, in cases where ZAGIS collects Sensitive Personal Data, it will notify the corresponding Owner to obtain his/her Consent in an express manner and clearly notify him/her of the purpose of the Processing of the same. - Options and means that the Controller offers to the Owners to limit the use or disclosure of Personal Data. With respect to the limitation of the disclosure of Personal Data, all persons in charge of the Processing of Personal Data at ZAGIS have signed an agreement by which they are obliged to maintain confidentiality regarding all information of ZAGIS or in possession of ZAGIS to which they may have access for any reason. The Databases containing Personal Data are kept within ZAGIS. The Databases stored in electronic format and allowing remote access can only be consulted by ZAGIS staff or service providers, using user names and passwords that must be changed periodically.
With regard to the limitation of the use of Personal Data, the Data Subject may stop receiving news from or information related to ZAGIS by submitting a request to ZAGIS, following the procedure indicated in section IV below. - Means to exercise ARCO rights. To exercise the rights of access, rectification, cancellation or opposition ("ARCO Rights"), in accordance with the provisions of the Personal Data Law, Data Subjects may submit the corresponding request to the ZAGIS address indicated in section I above, by means of a letter addressed to the ZAGIS Personal Data Department. The request for access, rectification, cancellation or opposition ("ARCO Request") must contain and be accompanied by the following: A. The name of the Data Subject and address or other means to communicate the response to his/her ARCO Request. B. Documents proving the identity or, where appropriate, the legal representation of the Data Subject. C. A clear and precise description of the Personal Data in respect of which one seeks to exercise any of the Arco Rights. D. Any other element or document that facilitates the location of the Personal Data. E. In the case of ARCO Requests for rectification of Personal Data, the Holder must indicate, in addition to what is indicated in this section, the modifications to be made and provide the documentation that supports his request.
ZAGIS will inform the Holder, within a maximum period of twenty Days, counted from the date on which the ARCO Request was received, of the decision adopted, so that, if appropriate, it will be made effective within fifteen Days following the date on which the response is communicated.
The aforementioned periods may be extended once for an equal period, as long as the circumstances of the case justify it. - Transfers of Personal Data that are carried out. ZAGIS does not carry out Transfers without having previously obtained the Consent of the Holder, when said Consent is required in accordance with the Personal Data Law. In the event that, at the time of collecting Personal Data, there is a need to carry out a Transfer for which the Personal Data Law requires the Consent of the Owner, ZAGIS will notify the Owner. In the event that the Owner does not object, it will be understood that he has given his Consent to carry out the Transfer. ZAGIS will notify the Third Parties to whom, where appropriate, it transfers Personal Data of this Privacy Notice and the purposes for which the Owner has subjected its processing. Where appropriate, the Processing of Personal Data by the Third Party must be carried out in accordance with what is agreed in this Privacy Notice and the Third Party must assume the same obligations that correspond to ZAGIS as the Controller. Notwithstanding the foregoing, ZAGIS cannot guarantee the Owner nor is it responsible for the Processing that the Third Party provides to the Personal Data.
- Procedure and means by which the Controller will notify Data Subjects of changes to the Privacy Notice. ZAGIS reserves the right to make changes to this Privacy Notice. Any changes to this Privacy Notice will be published in the same manner as before, on the company's WEB page: www.zagis.com. www.zagis.com.
- Mechanism to revoke Consent. If you wish to revoke Consent regarding the Processing of your Personal Data by ZAGIS at any time, you must follow the procedure established in section IV above. It should be noted that the revocation of Consent will not have retroactive effects and that Consent may not be revoked when the Processing is for the purpose of fulfilling obligations arising from a legal relationship between the Data Subject and the Controller, when such Processing is established by law or when any of the assumptions of exception to consent provided for in the Personal Data Law are updated.
